Acceptance

By accessing or using pollyonit (the "Service") operated by Chantilly Designs, LLC, doing business as “Pollyonit” ("we," "us"), you agree to these Terms & Conditions. If you do not agree, do not use the Service. Your use of the Service is also governed by our Privacy Policy.

Using the Service

You must be at least 18 years old to use pollyonit. You agree to use the Service to organize and join pickup games in good faith, to provide accurate information, and to treat other players with respect.

SMS consent

By providing your phone number to Pollyonit and agreeing to receive SMS messages, you consent to receive transactional SMS messages from Pollyonit related to recreational sports game activity, including game invites, RSVP confirmations, game updates, cancellations, and related notifications.

You may opt in to SMS messages when you provide your phone number during onboarding, profile setup, or profile updates and actively agree to receive SMS messages from Pollyonit.

If you are invited to a specific recreational sports game by a Pollyonit organizer who knows you, you may receive transactional, game-specific SMS messages related to that invite, RSVP confirmation, game update, or cancellation. These messages are sent only in connection with the specific game activity.

Consent to receive SMS messages is not a condition of purchase or use of the Service. Message frequency varies based on your game activity. Message and data rates may apply.

Reply STOP to opt out or HELP for assistance. If you opt out by replying STOP, you will no longer receive SMS messages from Pollyonit unless you opt back in where permitted.

Assumption of risk

Recreational sports involve inherent risk. You participate in games at your own risk and are responsible for your own safety and equipment.

User conduct and interactions

Pollyonit helps players find and organize games; we are not responsible for the conduct of any user or third party, whether online or in person at a game. You are responsible for your own safety when meeting or playing with others. We may suspend or terminate your access if you misuse the Service or violate these Terms.

Disclaimer of warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that games will occur, that players will show up, or that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Pollyonit is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. In no event will Pollyonit’s total liability exceed one hundred dollars ($100).

Intellectual property

The Service and its content are owned by Pollyonit. By posting game information, you grant us a limited license to display and share it as needed to operate the Service.

Indemnification

You agree to indemnify and hold Pollyonit harmless from any claims arising out of your use of the Service, the games you organize or join, or your interactions with other users.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in California.

Changes

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
